Research Into The Emergency Arbitrator In International Commercial Arbitration System

The emergency arbitrator system is a new mechanism resulting from thedevelopment of the international commercial arbitration practice. The new system isof great importance to the application of interim reliefs before the formation of thearbitration tribunal as well as the protection of the legitimate rights and interests of theparties.Just as other temporary preservation measures, the orders issued by theemergency arbitrators play a positive role in the smooth operation of the arbitrationproceedings and the execution of the arbitral award. The emergency arbitrator systemwill set off a new round of research upsurge of interim reliefs. The domestic researchon temporary preservation measures in our country is relatively less and has not forma system, so it is necessary to study the emergency arbitrator system combined withour own situation. This article mainly adopt the theoretical and comparative analysismethod, through the comprehensive analysis of the system, we will discuss relevantprovisions on the emergency arbitrator system of the major arbitration institutions,and to provide suggestions for the improvement of China’s system of temporarypreservation measures.
