Bankrupt law is a very important part of Business law. It is the law aboutthe termination of a company. As Enterprise Bankruptcy Law of thePeople’s Republic of China came into force in2007, the modernChinese bankruptcy legal system was established. This Bankruptcy lawmade a great advance compared to the old Bankruptcy law. Trustee inbankruptcy plays a core role in the whole bankrupt process. Trustee inbankruptcy is a person who manage and liquidate the property of thebankruptcy debtor. Therefore, the research of Trustee in bankruptcy isthe base of the research of Bankrupt law.The legal status of the trustee in bankruptcy is the basic question in theresearch, and is the source of other questions of the system of trustee inbankruptcy. In the article, I firstly compare the main theories of the legalstatus of trustee in bankruptcy and conclude that relationship betweenthe trustee and other parties in the bankrupt process cannot simply bedefined by one legal nexus.In the other parts of this article, I analyzed the rule of election, reward,right and obligation of the trustee in bankruptcy and made suggestionsto our legal system of bankruptcy.
