Since the reform and opening up, the household contract management rights systemin the liberation of the productive forces in rural areas, has played a very important rolein promoting rural economic development. However, with the deepening of reform andopening up, the development of industrialized society, the household contractmanagement system fragmentation and other defects are no longer meet therequirements of modern economic development. In this context, the land contract andmanagement rights transfer trend of increasing speed, which has become the mostimportant circulation land contract and management rights shares. Academia in thecountry, the land contract and management rights shares research is a relatively smallstake in the nature of the land contract and management rights, land contract andmanagement rights shares mode, there are still enormous controversy, the healthyoperation of practice for the protection of the right to land contractual managementstake to promote the healthy development of the rural economy, I selected this title, andwant to be able to contribute their efforts to the socio-economic development in ruralareas!Besides the preface, the epilogue, this article is divided into five parts, a total of abouttwenty-three thousand words, the main contents are as follows:The first part: this chapter revolves around the nature of the subject and shares ofagricultural land contracting rights expand, the author thinks that the agricultural landcontract and management rights of the successor body should include members ofcollective organization, but is not limited to the collective organization in farmers; innature, the author believes that the right of land contractual management investmentproperties should be the nature of real right transfer rather than dept nature of thecirculation.The second part: the chapter argues that the constitution、the property law givesfarmers the right to the transfer of agricultural land contract and management rights,which provides a legal basis for agricultural land contracting rights shares; From aneconomic perspective, the agricultural land contracting rights shares conducive toactivate the idle land resources in rural areas, an increase in land value-added benefits, increase farmers’ income from property.The third part: the author thinks that the joint-stock cooperative system is the productof history, the land contract rights practice, should be excluded this mode; the companyhas the integration of capital, profit and land contract rights become highly fit, shouldbe limited farmland contract right into share mode.The fourth part: the author thinks that the perfection of the registration system toprotect the security of transactions, ensure all the parties of the transaction; at the sametime in order to protect farmers’ interests of shareholders, the author thinks that shouldestablish equity withdrawal mechanism, allowing farmers to shareholders "voting withtheir feet".The fifth part: the author thinks that social security should uninstall agricultural landcontracting rights, advocated by improving the social security system to protect thebasic livelihood of farmers, maintaining social stability.
