“CPC Central Committee’s decision of some important issues in the process ofrural reform" was published in Third Plenary Session of the17th Central Committee ofthe Communist Party of China, In this document farmers were given the more sufficientand guaranteed right of contractual Land management, and the existing land contractualrelations were kept permanent stability. This is another important adjust on the Party’srural land policy after the right of contractual Land management was identifiedusufructuary rights in law. However, there are still a series of problems in understandingcorrectly and implementing this policy, such as, what happened to the content andproperty of the land contractual management right, What are the important influencefactors in carrying out the land contractual management right permanent stability, whatneeds to be adjusted in law and policy and so on.This paper analyzes from four parts, the first part summarizes the concept intensionand extension of the rural land contractual management right so far, sorts out scholarsview on the legal property of the rural land contractual management right before the realright law published. Based on this, this paper sums up the property of the legal propertyof the rural land contractual management right, which is formed of subject, object,contents and limit. The second part reviews the development history of the land systemsince the foundation of China, the following rural land contractual management right,analyzed the change on the land contractual management right in content and property,and analyzed the affections of policy, economy and farmers on the land system, andreveals the development laws of land system. Which provides way for researching thepermanent stability of rural land contractual management right. The third part analyzessome influential factors which may hinder the permanent stability of rural landcontractual management right policies implemented, and analyzes the formation ofthose factors. The last part proposes some corresponding Countermeasures andsuggestions from the ways of policy and law based on the above influence factors.
