The Beijing Treaty on Audiovisual Performances was adopted in Beijing, June26,2012. It is the first international treaty on audiovisual performances, which indeedfills the blank of the international system of intellectual property. This treaty willprovide the performers with wider and clearer protection. This article would set basison the treaty itself and use multiple methods, such as historical approach, comparativeresearch and empirical approach, to analyze the treaty and clear its relations to othertreaty. In addition, the importance and status of this treaty, and its influence on ourdomestic law will also be discussed.Due to the reason composed by the development of science and economy,performance was divided into vocal and audiovisual ones. International society hasalready paid enough attention and effort to protect vocal performance, but no treatyhas been adopted on the protection of audiovisual performance. The Beijing Treaty onAudiovisual Performances is the first attempt. This treaty consists of contents,preamble and30articles, which includes substantive articles, administrative articlesand final articles. It is a treaty in the realm of worldwide protection on intellectualproperty, paralleling the treaties on the protection of vocal performances.Signed in Beijing, the Beijing Treaty on Audiovisual Performances showsencourage to our work on intellectual property and raises China’s internationalstanding in a way. This treaty has significant influence on the amendment of ourdomestic Copyright Law, especially on the use of some professional terms, set andremedies of the rights on audiovisual performances. It provides a new area andthought.
