Abstract/Summary:
This essay mainly focuses on methods to protect consumers’ rights ininternational transactions, bringing some positive impact on the improvementof consumer rights protection since it encompasses a thorough study ofprotective method in international consumer contracts. Five chapters composethis article. The first section discusses the significance of internationalconsumer protection. This section starts with defining the connotation as wellas the extension of international consumer contracts. Then, features ofinternational consumer contracts are mentioned in the hope of clarifying thenecessity to protect consumers’ lawful rights internationally. The secondportion deals with the protection of international consumers’ lawful rights bymeans of substantial law. General analysis together with example discussionsis used. The third part emphatically focuses on the protection of internationalconsumers’ lawful rights in terms of conflict law. Thanks to the cross-borderspecialty of international consumer contracts, applicable law ought to bedetermined at the first place for the sake of guarding consumers’ legal rights ina better manner. This part follows the logic which begins with summarizationand ends with details. Through the lens of conflict laws, international consumerrights protection can be achieved in terms of the principle of privateinternational law, applicable methods and legal instances. The fourth sectorconcentrates on consumer protection in terms of the mechanisms of disputeresolution. The finale draws the conclusion that all parities efforts are requiredconsidering international consumer protection. The author has madehorizontal comparison between domestic law and foreign laws, and verticalcomparison in conflict laws before and after the issuance of Applicable Law onForeign Civil Relations of PRC.
