On Copyright Protection In A Network Environment

This paper compares our country’s network copyright protection’s legislative statusquo and the differences between the network copyright and the traditional copyright withother countries’. And it also discusses the basic content of network copyright. This paperpoints out the shortcomings of network copyright protection system in our country. Thedeficiencies are mainly manifested in the following aspects: the lack of procedural lawabout the holder of the identity confirmation process; it’s general about the definition andclassification of network; the definition and classification of the economic rights can’t keepup with the development of internet industry; there are many loopholes about theprovisions of network tort liability; and tort litigation jurisdiction is unfavorable to protectthe interests of the obligee. According to the existing problems, through comparison andanalysis of Chinese and foreign network copyright protection legislation, this papersystematically analyzed the present situation of the network copyright protection, existingproblems, perfect legislation, etc. And the end of this paper will give the originaltheoretical insights and perfect suggestion.
