On The Administrative Law To Protect Personal Information

With the extension of the field of administration, increasing public management and administrative powers tend to expand, more and more personal information is collected and used by administrative authority. This would threaten personal information. This paper attempts to standardize administrative powers and the protection of civil rights, the main information in the field of personal information, in order to create a harmonious development between modes in administrative law, executive power and civil rights.Personal information is an important community resource,"personal information has become a modern commercial and government-run base motives". Service administration and executive administration needs public government large-scale collection of personal information. The increasing complexity of IT is very convenient to make the government’s handling of personal information. At the same time, the Government make personal information constitutes unprecedented risks; the processing of personal information could lead to leaks, distortions and mistake. So that the administrative law protection of personal information has become an inevitable.The paper is divided into five parts. In the first part, the author gives the outline of personal information, including basic concepts, the theoretical basis of the legal protection of personal information. In the second part, the author analyzes the countries of the Personal Information Protection in Chinese administrative law and the legal framework for the protection of personal information. In the third part, the author explores the foreign personal information protection system, including the United States, Japan, Germany, a number of international conventions and the relevant law, gave a great revelation. The fourth part shows the administrative necessities legal protection and administrative protection laws and regulations of the personal information. In the fifth part, the authors put forward some useful suggestions. The construction of the introduction of the right to personal information management, process control and personal information related to administrative acts, the effective convergence of the personal information protection system and the government information disclosure system supervision and relief system. On the whole, the administrative law establishing the key to the protection of personal information is a balance of control over the executive power to protect civil rights, the pursuit of the interests of the game.
