Diversion Of The Prosecution Phase Research Program

In response to the contradiction between the rising number of crime cases and the shortage of judicial resources, the procuratorial organs are built up a system of the case in examination and prosecution stage, to ensure that the procedure of trial can be effectively, and make the defendants who are not sentenced to punishment can return to society as soon as possible. At present, for China’s criminal procedure law, there are two kind of examination and prosecution stage diversion system, namely the discretion not to prosecute system and conditional minors not to prosecute system. And the second system is through new formulated in the criminal procedure law of the People’s Republic of China that held in March14,2012, the11th National People’s Congress fifth conference, this system is on the basis of the lessons draw from foreign experience, the establishment of this system makes the public prosecution organs out of the single distribution mechanism in our country’s before, it improve the distribution mechanism of procedure in the examination and prosecution stage in our country.
