Transforming robbery is the original concept of the criminal law scholars in China,and it’s a fiction of law provisions.For certain purposes,the criminal who commitstheft, robbery, fraud,used to behaving violence or threating.Then the nature of thebehavior changes and the behave becomes transforming robbery.Transforming robberytheoretical research in China’s criminal law scholars and achieved certain results.Butin some areas, there’s loophole which reflects the attention of China’s criminal lawscholars transformed robbery remains deficient.As transforming robbery casesincreasing in trial practice, theoretical research seriously affected thejudgment.Therefore, this article based on judicial cases, the theoretical circlestransforming robbery controversial point of view of the constituent elements andpatterns of crime in turn is reviewed and published author’s point of view.The paper is divided into three parts,.The first part is identifying the preconditions oftransforming robbery.The existing provisions,judicial interpretation of criminal lawprinciples and case analysis, followed by comment on different theoretical point ofview, clearly the most fit judicial practice a prerequisite transformed robberyunderlying behavior does not necessarily constitute a crime.As a result, RelativeCriminal Liability Age can be the subject of transforming robbery.The second part isidentifying the subjective and objective conditions of transformingrobbery.Transforming robbery the subjective purpose should follow the dual purpose,in judicial practice specific conditions.
