The Research Is About The Human Resources And Judge Configuration In Basic Court Of Shandong Province Affecting The Trial Efficiency

China has established a socialist country ruled by law, implement the country according to law to rule the state. A fair, efficient and judicial trail becomes the public’s more and more urgent and just appeal. In the background of the whole court system’s efficiency is not high, because the basic court in special basic position, the trial efficiency compared to the public’s expectations is the particularly problems. It brings a challenge to protect the legal rights of parties and achieve social equity and justice. This paper based on the current basic court judicial practice, uses histology and public management knowledge and the theory of the organization, judge configuration and trail efficiency, analyses the factors restricting the efficiency, approach and find solutions how to improve the trail efficiency.The paper is composed by four parts. The first part, discusses the fundamental theory about internal institutions, judges configuration and trail efficiency in basic court. The basic court in the national judicial system has the basic status and the important function, we can say the basic court’s judge efficiency to a great extent determine the national judicial system trial efficiency. The paper analyses the general principle about the internal institution and judge configuration in basic court. The conflict within the judicial power and executive power double-powered structure is the logic starting point to understand the judge rules, expounds the meaning and value of the trial efficiency, the dialectic relations between trail efficiency and judicial justice, points out that the late justice to the parties it might mean that injustice. In the operation of the modern society, especially in the economic field, judicial activities must have great speed can well satisfy the efficient running society, realize its safeguard social justice mission.The second part points out that the court system within the agency inflation too much is universal, the judges handling the case as the centre work is obviously insufficient in number, the structure is not reasonable. Basic courts have become more prominent. Internal institutions, judge configuration directly affect the efficiency of trial.The third part, finds out the questions at the internal institutions, judge configuration and trial efficiency, analyses the bottleneck to improving the trail efficiency. The factors restricting trial efficiency is multiple level and various, various factors and mutually intertwined and influence each other, separately from the macroscopic and microscopic aspects analyzes the impact of the court judgment factors restricting efficiency. The administrative and irrational management, the judge system of non-professional and administrative management, lead to the internal institutions too much and irrational. Judges configuration can’t reflect the centre work of trail and much other microscopic effect restrict trial efficiency.The fourth part discusses and find out the reform measures at internal institutions and judge reasonable configuration. Points out constructing the scientific and reasonable framework in order to improve the judge quality and efficiency, constructing internal management structure scientifically, promote the judge professional construction, from the macroscopic system to solve the problems that influence the trail efficiency. To set up a reasonable set of institutions and the court judge resources allocation, this paper designs a three-step reform path to solve problems in trial efficiency from the micro level.
