In recent years, the number of patient disputes rose sharply, the doctor-patientconflicts has become an indisputable fact, and the contradiction of the core issuesfocused on the rights of the patients who failed to received due respect, many actswhich ignore patients’ rights.The behavior of excessive medical is the most prominentThe health care system is certainly flawed systems thinking and regulation of patients’rights and the lack of institutional level, however, the medical profession and the legalcommunity can not be ignored, practicing medical staff, despite some substantialincrease academic qualifications, but patients what rights, as well as a unified and aclear understanding of how the right to respect for and protection of patients in themedical event. Jurisprudence, except a handful of professionals with a medicalbackground to give patients the right to concern in the legal aspects of patients’ rightsand systematize and institutionalize the very few studies. In view of this situation ofincrease of medical main acts of excessive medical research is very necessary. Thispaper focuses on the widespread excessive medical practices from the medical bodystart focusing on the provisions of the Tort Liability Act, to excessive medical actsdescribed and analyzed from various angles, in order to formulate correspondingpolicies of our government have important reference value.In addition to the introduction and conclusion, mainly consists of four parts. Thefirst part of an overview of acts of excessive medical, a concept introduced excessivemedical practices, characteristics, nature, and from multiple Excessive medical andbehavioral causes and typed. The second part of the combination of tort liabilityidentified excessive constitutes the basis of liability of medical behavior andexcessive medical tort liability, attribution and compensation in-depth analysis. Thethird part focuses on the legislative requirements and defects of "Tort Liability Act".The fourth part is the excessive medical practices and remedies, to provide some effective measures to ease the patient disputes caused due to excessive medicalpractices of sharping.
