On The Legal Protection Of Student Freedom Of Expression

As a kind of basic human rights, the freedom of speech is of great significance for personal development and social progress. As citizens of a country, whether the students can grow healthily or become qualified citizens depending on the freedom of speech. Although the students should have had the freedom of speech, they experienced a long time to obtain such kind of rights. Influenced by the traditional concepts of education and the strong control from schools and teachers, the students are lack of sense of being a master both in class and campus, and even outside school. On the other hand, the imperfection of both legislative and judicial system leads to the students’freedom of speech cannot be protected effectively and timely, which should have been taken seriously. On the basis of analysis of the establishment process of students’free speech, I studied the value, achievement and limitation of the students’ freedom of speech from the perspective of legal protection. In view of the problems exited in the protection of students’freedom of speech, combined with beneficial achievements by foreign developed countries under the rule of law, I put forward some preliminary thoughts on the students’freedom of speech to improve its legal protection.
