| With the intellectual property rights becoming one of the three new issues of theGATT Uruguay Round Negotiations，Geographical Indications，one of the "Trade-relatedIntellectual Property"，has become an issue in the Doha Round of Negotiations onintellectual property issues.It has been deeply concerned by the United States and theEuropean Union, and becomes the important factors that affects the2003Kemp WTOFifth Ministerial Conference and the Doha Round Negotiations，especially after theTRIPS Agreement, the protection of Geographical Indications has got more and moreattention.However,while this problem is get more and more attention from theinternational community,it does not cause too much attention in the domestic.So makesthe system of legal protection of Geographical Indications in China is not perfect, itseemed more "confusion",which has led to the protection of Geographical Indicationscontroversial practice, constant conflict.Therefore，this paper described the protection of Geographical Indications in detailwith the case studies and comparative analysis through four sections.Firstly，In this paper, we use typical cases to begin the discussion on the protection ofGeographical Indications，then we point out the main problems in the protection ofGeographical Indications and analyze the reason through the two typical cases.Secondly, we analyze the current situation of the protection of GeographicalIndications for further in the second chapter.Then we investigate the protection history ofGeographical Indications in China and make a comparative analysis of the current systemof protection about Geographical Indications.In the end,we summarize the conflict in thecurrent Geographical Indications protected mode of China.Thirdly，In order to provide ideas and learn to improve China’s protection ofGeographical Indications mode. we make a comparative analysis of foreign protectionmode of Geographical Indications，and make an research and thinking on relevantinternational treaties.Finally, for the hope that we can provide a useful reference for China to improve theprotection of geographical indications.the paper put forward ideas and suggestions for the coordination of conflict in Geographical Indications protected mode according to theprevious analysis in the last section. |
