The Legal Analysis Of The Doctor-patient Disputes To Entrust The Third Party Mediation Mechanism And Research On Its Perfection

Within the period of social transition of our country, there are various socialcontradictions, especially since the medical reform. The medical reform is notcomplete and social services are severely which lead to frequent doctor-patientdisputes and medical violent matters. As a diversified dispute mediation mechanismentrust the third party mediation system, to some extent, ease the tensions between thetwo sides, but in the context of the social crisis of confidence, some patients stillsuspect the third-party’s neutrality. Doctor-patient disputes to entrust the third partymediation mechanism itself exists defects, hinders the further development of thesystem itself. In order to promote the doctor-patient disputes mediation mechanismfurther development, this paper will analyze several typical models at home andabroad, explore the legal value of the system, analyze the problems of distrust, findout the corresponding countermeasures, and further improve the system.The paper is divided into three parts: the introduction, the text and theconclusion.The introduction mainly introduces the research background, research situationat home and abroad and the research methods of the current doctor-patient disputesentrust the third party mediation mechanism in ChinaThe text part is divided into five chapters.The first chapter explores the status quo and the problems of the currentdoctor-patient disputes mediation mechanism, and analyzes the advantages of theintroduction of a third party mediation mechanism into the medical disputes in China.The second chapter finds out the deficiency of the current doctor-patient disputesentrust the third party mediation mechanism——lack of trust, through exploring ourcountry’s current doctor-patient disputes to entrust the third party mediation models,and analyzes its causes.The third chapter analyzes the doctor-patient disputes to entrust the third partymediation mechanism in China from two aspects: the legal value and the legalrelation. The fourth chapter through reading and thinking the solution modes for foreigndoctor-patient disputes, finds the areas to learn, in order to improve our doctor-patientdisputes to entrust the third party mediation mechanism.The fifth chapter brings forward further suggestions for improvement of thedoctor-patient disputes to entrust the third party mediation mechanism, especially forthe trust issues. Three main areas to improve: supplement the body of the operatingmechanism, improve the legal system, and explore China’s medical reform path.The last is to draw a conclusion.
