On The Supervision Of The Execution Of The Civil Case By Procuratorial

March2011, the Supreme People’s Court and the Supreme People’s Procuratoratemade the joint statement Notice to conduct tests in some areas to supervise the executionof the civil case, which had regulated the scope and the form on how to supervise, andasked the procuratorates in the areas to conduct tests to regulate and support the courts’execution. This was the first time ever since20years that the Supreme People’s Court andthe Supreme People’s Procuratorate made the joint statement on supervising the executionof the civil case. In order to strengthen the supervision, it was needed to study and discussdeeply on the principle, the procedure, the scope and the form of the supervision, to makethe supervision system more scientific, reasonable and sufficient.There were4parts in the paper. Part1was the outline, which mainly introduced therelative concepts of the execution of the civil case, the supervision of the execution of thecivil case, and the supervision of the execution of the civil case by procuratorial.Part2was the study of the practice of China, which was mainly about the problemsand the causes of Chinese execution of the civil case, the supervision of the execution ofthe civil case, and the supervision of the execution of the civil case by procuratorial.Part3was the study of other countries’ and regions’ systems of the execution of thecivil case, and the system of the supervision of the execution of the civil case, whichmight benefit the betterment of the Chinese Legal System.Part4was about the betterment of the Chinese system of the supervision of theexecution of the civil case by procuratorial, which mainly studied the practice andproblems of the legislation of the supervision of the execution of the civil case byprocuratorial, and conceived the modes of the betterment of the execution of the civil caseby procuratorial, and consummated the legislation of the supervision of the execution ofthe civil case by procuratorial.. Additionally, the paper advised that the form of thesupervision should be simplified to the procurator’s opinion.
