Discussion On The Perfection Of Chinese Pirce Hearing System

Hearing plays an important role in adnimistrative procedure law, focuses to reflectthe modern princoples of administrative disclosure and puplic participation, and ensuresscientificity and democracy of administrative actions. To allocate resources rationally,develop economy healthly and keep society stable, China has formally implemented PriceLaw on1st, May1998, and established the price-hearing system, afterwards Regulationson hearing of governmental price dicision have come into effect on1st, December2008,to perfect price hearing system.However, not only the establishment of price-hearing system by Price Law, but alsothe perfection of the system by Regulations on hearing of governmental price dicision, cannot solve the problems exsiting in current price-hearing system, such as the unreasonableelection of representatives and the unclear effect of price-hearing notes. These problemshas blocked the system’s efficacy. Based the currently relevant laws and regulations andpractical cases, this thesis analyzes the price-hearing system, and proposes solutions toperfect relevant procedures, hoping to develop the price-hearing system.The main structure is as followed: the first chapter, overview of price-hearingsystem,mainly introduces the basic theories, classifications of price-hearing, elaborates themain contents of this system and analyzes the hisroty and status of chinese price-hearingsystem. The second chapter, based on the analysis of price-hearing system’s legistive andpractical status, summarizes the problems of this system in aspects of applicants,procedures of meetings, election of representatives, effects of hearing meetings’ notes,supervisions and remedies. For these problems, with systematical analysis and successfulforeign ecperiences, I advice in the third chapter to enlarge the scope of price-hearingparticipators, reasonably arrange the specific procedures of price-hearing meetings, clarifythe legal effects of meetings’ notes, and establish effective and practical remedies forprice-hearing and so on.
