The public prosecution is a very important function of the procuratorial organs whichact as the legal supervisor of the country. And it’s very effective means of punishing andfighting against crime. Prosecution must have public credibility sufficiently since itexercises of powers on behalf the governments and it must be up to statutory standards. Soit could be ensured that the criminals should be investigated by law and the innocentpeople should be prevented from the criminal punishment, and the fairness and justice ofthe law of our country should be safeguarded. So it’s the key whether the function can beexercised rightly what the prosecuted proof is. Aimed to the problems existing in thenational proof standards of public prosecution, the author proposed a gradual scheme toimprove the public prosecution proof standards in this paper.Views are expounded from flowing four parts in this paper.Part I, the Features and Functions of Public Prosecution Proof Standards. The basicconcept features and functions of public prosecution proof standards are introduced in thispart.Part II, the Current Situation of Abroad Public Prosecution Proof Standards. Theproof standards in both civilian law system and common law system are introduced, andthen we compares the two proof standards in both civilian law system and common lawsystem.Part III, the Current Situation of National Public Prosecution Proof Standards.Relative regulations about the standard in current laws are introduced, and problems infour areas are figured out in this part.Part IV: Reconstruction of Public Prosecution Proof Standards in Our Country. Theauthor proposes the principles of improving the public prosecution proof standards andputs forward two ways basis on the principles above in this part.
