China, as one of the most populous country, is also a tobacco producing and consumingcountry. The tobacco industry has an important position in the national economy. Status oftobacco and its products in the national economy as well as its specificity find a reasonablebasis for the state’s monopoly.“Law of the People’s Republic of China on TobaccoMonopoly" indicates the monopoly management system of tobacco industry, the productionand management of tobacco monopoly commodities in a planed way, and Tobacco production,sales and import and export business is unified. However, because of limitations of tobaccomonopoly administration system and China’s current status of administrative law enforcement,the enforcement of tobacco monopoly law accompanied by risks, which disrupts the healthydevelopment of the tobacco industry seriously and brings challenges to China’s administrativeenforcement. Therefore it’s essential to execute risk prevention and control for tobaccomonopoly administrative enforcement.So, In this paper, on the basis of tobacco monopoly administration law enforcement oflegal norms,using the experience of general practice of administrative law enforcement,theauthor on the basis of the theory of administrative law enforcement through analysis oftobacco monopoly administration law enforcement risk to put forward to improve the tobaccomonopoly administrative law enforcement level and control of tobacco monopolyadministration law enforcement measures of risk.In this paper the text is divided into four parts, totaling more than30,000words exceptthe introduction and conclusion.The first part analyzes briefly on the theory of risk prevention and control of tobaccomonopoly administration enforcement, which explains for the research of the necessity of riskprevention and control of tobacco monopoly administration enforcement. The second partanalyzes the current performance of several tobacco monopoly administrative enforcementanomies, and the reasons for the existence of risks. The third part describes the legalrequirements in the United Kingdom, the United States, Japan and other developed countries in terms of administrative enforcement. In the last part of the article the author draws on theadvanced practices of these countries and makes a reasonable proposal on the reform ofadministrative law enforcement.
