The taxi is an important part of urban public transport,it is one of the main ways peopletravel, with the flexibility and convenience features. The taxi market is not as perfect as others,in recent years, taxi trade problems are frequent, such as “Black car difficult to cure”“taxidifficult”“taxi drivers transport strike”“price adjustment storm” etc. Behind these questionsis imperfect of the taxi franchise system, the core of the problem is to solve the taxi franchise.The taxi industry to implement the franchise system, government regulates the taxi franchise,so numbers of taxis are strictly controlled. Under the franchise system, the governmentlaunched the taxi company to operate, allowing only the taxi companies engaged in businessactivities, the right to limit or cancel the self-employed, so that the taxi companies tomonopolize markets, monopoly interests. The right to be canceled due to the self-employedtaxi driver can only be contracted taxi company, subject to taxi company, to pay amanagement fee to the taxi company, most of the income is obtained from labor income taxicompany, taxi companies and taxi drivers contradiction by the interests of a dispute graduallyexpanded transport strike incident occurred in recent years, and more contradictory magnifyperformance. They undermine the social welfare anddisturb the market order, not conducive to healthy development of the taxi market. The taxi isthe direction of market-oriented reform of the taxi industry’s future development is to solvethe bottleneck of the development of the taxi industry fundamental way. The reform of taxifranchise is a prerequisite for the right to operate taxi market, clear property rights andmanagement rights to determine the subject, object and content of rights and obligations, toestablish a complete production, changes and elimination system. Interests of consumersamong government, taxi companies and taxi drivers should be adjusted, strengthen the role ofthe taxi industry associations. Taxi franchise system is market-oriented. Fair and reasonableallocation of taxi resources contributes to promoting competition in the legitimate taxi tradeand stimulating the vitality of the market. Select the appropriate market characteristics around the business model, breaking the monopoly of the state of the taxi company’s market. Then itdraws a conclusion that the taxi trade needs market reform. It can promote fair competitionand stimulate market activity in taxi industry.This thesis use comparative and literature research methods, and investigate taxifranchise in many places. It provides the theoretical support of civil and commercial law forthe reform of taxi franchise system to improve theoretical support for civil and commerciallaw of the taxi franchise system.Chapter one analyzes the concept features of the right to operate a taxi, and recalls thehistory of the reform of taxi franchise in china in order to have a basic understanding to taxifranchise.Chapter two expounds the business model of taxi trades in china, and evaluates variousmodes. It analyzes the pros and cons of various models. This gives a reference forforeign business model.Chapter three analyzes the legal right of taxi franchise. It clears the legal nature, legalrelationship and achieved ways of taxi franchise. It introduces the appearance, change andtermination of management of taxi and gives a legal basis for building a systemof management right for taxi.Chapter four suggests recommendations for market-oriented reform of China’s taxifranchise. It improves recommendations of taxi franchise in china that formulate thefranchising management, regulate the taxi company, safeguard the interests of the driver,safeguard the interests of consumers, etc.
