The Research Of Legal Issues In The Reconstruction Of The Urban Village

Urban village is a particular issue with Chinese characteristics raised against the background ofurban and rural dual system in the process of social transformation. Urbanization not only providescity economy with great impetus but also enlarges the scale of cities and expands the urban land. As aresult, the villages along the urban edge become annexed, which forms the urban villages in the senseof reality. However, there is still a big gap between the economic structure, management pattern andcultural landscape inside the villages and those of the surrounding cities because of various factors.Thus, the intensive utilization of urban land and the sustainable economic development are badlyrestrained, which hampers the urban modernization. So it’s a serious issue needing research andmethods to reform the urban villages. This paper, from the perspective of laws, will analyze the issuesencountered in the practice of urban village reform and propose some countermeasures.The whole paper falls into four parts: Part1: a comprehensive analysis of urban villages,meanwhile the necessity of reform will be pointed out. Part2: a brief introduction of the currentinstitution of the alteration in terms of the rights of the collective land in the urban villages will begiven as well as the defects of it, on the basis of which a comparison between the newinstitution—collective land nationalization, and the current one will be conducted. Part3: elaboratingthe issues raised in the reform of collective economic organization, discussing several existing reformpattern and proposing the corporate-based reform.Part4: the research of the law-related issues of the arrangement and security of those who lost theirland and the discussion of right protection for the most beneficial parts in the process of urban villagereform will be made with the goal of establishing a much more perfect legal security system for theland-lost farmers of the urban villages.
