Recently the real estate industry of China is in the upswing. With the development ofresidential commercialization, the rights of the property owners have also gainedunprecedented attention. Since “The property law” which was established in2007improves the rights of owners, there are still something not just as one wishes. Forexample, the regulations on the owners’ committee is not very well. As the representativesof the owners, the owners’ committee plays a very important role in the affairs to solve theproblems between the owners, the community management company, and others, and soon. However,“The property law” failed to definite the legal status of the owners’committee clearly, which made it impossible to solve the problems in judicial practice. Inorder to stabilize the legal relationship about the owners’ committee and establish thefoundation of the rule of law, we must do something. to clear the legal status of theowners’ committee. This is also the reason why the topic of this paper is proposed.According to research the topic, we expect to clear the legal status of the owners’committee. It can promote the legal system of owner’s committee, at the same time we canalso solve the problems in practice better. In brief, the owners’ committee can run betterand play its due role. Thus that also contributes to the healthy development of the propertymanagement industry and the harmony and stability of the society.
