Today, we have made our passage into the global information age. More and more electronicdata goes into domain of criminal proceedings as novel evidences. Due to the unclearness and lackof supervision, there were so many issues exposed in the criminal prosecution. Hereby, integratingprocuratorates’ practices in NingBo, the following thesis makes analysis of above mentioned issuesand proposes the relevant solutions. Hope it to be workable for the judicial practices in the future.The thesis including three sections:In Section one the author describes operations of electronic data in the criminal prosecutionpractices. The author found the electronic data were mostly used for inquest, examination, andidentification in the practices of NingBo procuratorates. In the happened job-related crimes cases,inquest was the important technological means and the electronic data had become the clues forsolving the cases. In the criminal proceedings, examination and identification are two importantfactors of the electronic data used as evidences. They are the key points for judging.In Section two the author makes analysis of the issues exposed in the operations of theelectronic data. There are some issues exposed when practicing the electronic data, such as therelevant laws are not so completed, cooperation is not inadequate, and the practical operation is notnormative. These are serious FAQ.In Section three, the author proposes some countermeasures and suggestions for theapplication of electronic data for criminal prosecutions department. According to the analysis ofthe issues exposed in the practice, the author thinks that we should improve the practice of theelectronic data with five points. First, we must improve the existing laws and detailed workingrules, so that we can do better in using the law to guide practice. Second, We must establishcoordination mechanism and expert supporting mechanism to integrate resources and playing atechnical force. Third, we must apply technical means and supervision system to supervise thewhole process of the application of electronic data. So, we can ensure electronic data legitimate and effective. Fourth, we must make training plan to teach our technical staff, and set up a stabletechnical team to ensure the smooth operations. Fifth, we must ensure capital investment,establishing laboratories and certification system to ensure that the accurate use of the applicationof the technical specifications.
