It has been firmly believed that the position of dominant market and the regulation of the abuseof dominant position as the core for the legislation and law enforcement of all countries andregions’ Antimonopoly Act, by making a general survey. In recent years, the abuse of dominantmarket is increasingly severe in China’s telecommunications. It is more obvious that Telecomenterprises in China dominating the market tend to abuse their market forces and restrictcompetition, compared with the same field abroad. With the situation of the formation of threeoperators to segment the market after the restructuring of China’s telecom industry, it has impactChina’s inherent telecom regulation system greatly after the promulgation and implementation ofthe Antimonopoly Act.How to regulate the conduction of the dominant market operators to protect the normaloperation of the telecom market and maintain the consumer’s legitimate rights and interests hasbeen a challenge of utmost urgency for the Administration of Justice and Antitrust regulators.With regard to the imperfection of the litigation system and sanction system of the behavior oftelecom industry in China abusing dominate market status. The chapter one has analysed therelation between telecom industry and antimonopoly act, and it showed that abusing dominantmarket status in telecom industry antimonopoly is the toughest thing to regulate from theory.The chapter two has analysed the concrete forms of abusing dominant market status. Inaddition, combing with specific case of judicial practice to identify telecom enterprise whether hasthe behavior of abusing dominate market status. The chapter three has in-depth explore the legalflaws in the formulation and implantation on the basis of current regulations of telecom industryabusing dominant market status. The chapter four has offered some constructive proposals toperfect the antimonopoly act litigation system and sanction system for which has involved in theprevious content.
