On The Abolition Of Juvenile Crime Records In China

In the field of criminal law to minors，the abolishment of Juvenile Crime Records has beenestablished in many couriers as the socialization and reprieve of Penalty developed. The existenceof the system eliminates the adverse impact of the criminal records of minors in large extent. Thesystem protects the interests of the minors as well as the human rights. Our country now is pushingthe criminal policy of combing punishment with leniency. By the idea of rule law, the voice ofestablishing the abolishment of Juvenile Crime Records has been increasing. The Eighth CriminalAmendment dispensed the minors’ duty of criminal records. China’s newly revised Law ofCriminal Procedure has regulated the closing of criminal records. Both of them lay a goodfoundation for the abolishment of Juvenile Crime Records. The practicing in our country alsoprovides useful experience. Now, the system is not established in China, Combined with ourexisting national conditions, this paper tries to give some ideas of the constitution of abolishingJuvenile Crime Records by analyzing and learning the systems in foreign counties to providefeasible suggestions.This article is divided into five parts, the first part mainly discusses the concept of criminalrecords and abolishment of Juvenile criminal records, this part also analyze the value of the systemof the abolishment of Juvenile Crime Records. The second part wants to learn advanced experienceand achievements overseas by investigating the theory of elimination in foreign countries. Thethird part analyzes the feasibility and necessity of this system. The forth part will put somequestions of establishing such system in China including legislation, ideas and so on. The fifth partstates the initial configuration of the abolishment of Juvenile Crime Records including principle,condition, mainly procedure and corresponding measures.
