With the reform and opening up, the thoughts of socialization and humanitarianism ofpenalty execution in foreign countries has penetrated into our country. In accordance withthe concept, the temporary execution outside prison system emerged at a historic moment.Temporary execution outside prison system, however, has its defects about which furtherresearch needs to be done.This paper is divided into five parts: the first part is based on the present situation ofthe prison execution penalty of our country presented research background, purpose andsignificance of the paper. By studying some related academic books, papers, and journals,the article collected some of the study about the system of the United Nations, the UnitedStates, Canada and other countries, summarizing the research status abroad. At last, theresearch methods of the thesis were introduced. The second part introduce the concept,characteristics and historical development of temporary execution outside prison. Thethird part, it showed some similar systems abroad such as delay or interrupt freedompenalty of Germany, stop freedom penalty of Japan, residence execution of Italy, anddeferred serving of Russia. The forth part, it summed up the problems existing inlegislation. The fifth part the paper put forward the measures of it.standardize themaking-decision phase of temporary service outside prison, protect the rights and interestsof the victim, and further perfect the most problematic medical parole on procedure. Lastly,perfect the responsibility of the prosecutorial supervision in the beforehand, process andafterwards stages and improve the temporary execution outside prison managementmeasures at the same time to make it work more effectively and intensively.
