Analysis On The Relationship Between National Law And Folk Law

Folk law problem is present in the process of the construction of a socialist countryunder the rule of law is an important issue. Folk law exists widely in society, it has to do withcountry there are both conflicts and contradictions between formal method, and mutualcooperation, mutual fusion. Ancient folk law based on the background of the rural society, alot of content has evolved with the needs of the development of modern society. As the oldmode of social change and the corresponding social organization system innovation andchange, folk law have taken place in its rheological, has the new meaning and content. Sincethe1990s, the related theory for its unique perspective of folk law aroused the interest ofmany scholars study the rule of law theory, this paper has attempted to folk law in the currentacademic circles are discussing categories to define, and then studies the rule of law practiceproblems domestic discipline and interactive relationship of folk law in China.Based on this, this article is divided into four main parts, the basic framework and maincontent is as follows: the first part, from the perspective of the definition of folk law, thispaper introduces the said to three different kinds of folk law, and concluded in this paper, thedefinition of folk law.
