Analysis On The Case Of Xia Junfeng

A case of Xia Junfeng, happened in2009, has attracted intense attention of socialcommunity and widely disputed since the case was brought to trial. Considering CriminalLaw, Criminal Procedural Law, Jurisprudence, this paper will focus on the conviction andsentencing, the evidence, the proceeding of the case, in deep analysis. Finally, according toinformation collected, the author will show her own perspective about the case.In this paper, except the introduction part consists of five parts.The first part is the brief introduction of details of a case.The second part is the discussion on the evidence of the case. In this part, the authorintroduces rules and regulations concerning proof on death penalty cases. Then based on therules and regulations, the author find the proof illegally used on this case.The third part is the discussion on the proceeding of the case. There are rules andregulations about proceeding in China law system. In addition, the author analysis proceduralproblems, existing in this case.The fourth part is the analysis on the conviction and sentencing of the case, including thecontroversy on conviction between public prosecutor and defense attorney, whether thedefendant’s behavior is self-defense and whether the defendant voluntary surrenders.Eventually, according to the discussions above, the author come up with individual point onthe conviction and sentencing of this case.The fifth part is the conclusion, which mainly includes problems reflected by this caseand the media’s affects on a criminal case.
