According to the latest statistics, it shows that China is a populous country, and also is acountry with its number of Internet users into geometric growth. There are accounted for10%of the visually impaired people in China. These people has a strong desire to obtainrelevant news, policies and regulations, and entertainment information, etc. through thecomputer network. However, because of their individual physical defects, they could notbe able to access the information via the Internet as the people as normal vision do. Oneof the most important barriers is the technological measures and anti-technique elusion.In terms of the modern society, people’s survival and development is inseparable frominformation resources, and more and more people tend to get information resourcesthrough the Internet. And the network of technical measures and anti-circumventionprovisions setting, to a certain extent, affected the public for copyright fair use, and alsoimpact the public accessing to information.With the popularity of the Internet and its technological development, Network technicalmeasures and anti-circumvention are the technical methodologies that are used bycopyrighters and copyright-related rights holders in order to prevent unauthorized using oftheir works. Network technical measures and anti-circumvention are now have therecognition of the world copyright organizations and international copyright treaties.These measures usually could be used to prevent the unauthorized access to works.But also affected the public laws have been confirmed for the rational use of copyright.For the visually impaired, the current law does not give them completely right tocircumvent technical measures in the network, thus affecting their capabilities ofaccessing to relevant information through the Internet.The legal protection study of the access right to information for visually impaired personswas started in the early2000s. What its attracting people’s attention is along with the development of network technology and the progress of social civilization. To balancethe public interest and the protection of vulnerable groups the right to access toinformation, it is necessary to circumvent technological measures of exceptions in thevisually impaired to be stipulated.
