Bankruptcy revocation rights can help to revoke the improper handling acts of insolvency estate for the creditor within the statutory period, regulate the behavior of various escape debts, protect the lawful rights and interests of creditors so as to ensure the realization of the function of the system. Therefor, there is no doubt that the cancellation right is ofgreat value and dracticality in the Bankruptcy Law.This paper firstly from the based theories of bankruptcy revocation rights, through the introduction of the evolution and current legislation of bankruptcy revocation rights at home and abroad, the necessity of improving the system of bankruptcy revocation rights of our country is expounded, and the suggestions to complete the system are offered. Hoping that it will contribute to the improvement of bankruptcy revocation rights.This paper is divided into four parts. The paper firstly from the based theories of the right of bankruptcy rescission, the concept, nature of law, historical origin, inefficient system and the right of revocation of system relations. Secondly, illustrates the right of bankruptcy rescission of our bankruptcy law, analyses the cause of the problem in practice. Thirdly, analysis of overseas mature relevant provision, solve our problems. Finally, puts forward related suggestion.
