The problem of protection of practical works of art to become our country’sdevelopment of intellectual property law must face and solve a problem. The utility ofart has the obvious difference with the general art, it widely exists in people’s life, is thepeople in the long-term life actively play their one’s ability and cleverness and has apractical value and artistic value of the works, embodies the people’s pursuit for beauty,and which widely exist in daily life in economic development, and plays an importantrole in the. The utility of art has its unique value of intellectual property rights should beprotected under intellectual property law and copyright protection, international manycountries on the copyright protection of the law, such as the UK, USA, France and so on,clear law or case law means provided legal protection of works of applied art. With thedevelopment of economics globalization, the law of intellectual property rights and theadjustment has become a trend in China’s legal development. In this paper, the"practical artwork copyright protection" is in this international and domesticbackground of understanding and discussing the related legal issues. This paper isdivided four parts, the first part introduces the protection system of works of applied artforeign copyright and conservation status of China, in the background of internationalof international conventions and more representative of the United States, France legalprovisions on the legal status, further analysis and on the basis of practical works of artin China provisions. The second part introduces the definition of works of applied art,only in the understanding of the basic legal theory to further explore the issue ofcopyright protection, which describes the relationship between the connotation,characteristics and related arts, arts and crafts, industrial design and other relatedconcepts, laid the theoretical foundation for the whole the paper. The third partintroduces the practical works of art should be subject to copyright protectionconditions, namely its copyright, first introduced the characterized by originality, practicality and artistry of phase separation which, combined with the legal provisionsof other countries to further comparative analysis of its copyright reasons. The fourthpart introduces the construction of practical works of art of the copyright protection ofthe legal system, and combined with the practical works of art related legislation inforeign to our country’s relevant legislative suggestions.
