In the world are in economic crisis, China still maintained a high economicgrowth. Chinese people have gradually adapted from cash payments to the credit card payment transaction pattern. The resulting credit card crime has becomeincreasingly prominent countries in order to combat economic crime, and maintain financial management order, protect people’s life and property safety of the introduction of the appropriate legal basis. However, due to credit card fraud is anew type of crime, criminal means diversification, theoretical and practical understanding of the relevant issues divergence. Therefore, this paper start from Zhang credit card fraud, credit card fraud based on judicial practice is more common in the difficult problem that how to carry out the credit card crime conviction and sentencing of legal issues such as analysis," fraudulent use " credit cardand "ATM machine can cheated "and other specifically identified criminal conduct research. And with reference to2008Zuigao Jian released a judicial interpretation "on the Lost people’s credit card and automated teller machine (ATM machine) on how to use the qualitative behavior of the problem of approval", analyzing the provisions of the relevant content, and ultimately raise the machine can be regarded as a natural person. In conclusion, I hope this article on creditcard fraud in the understanding and application of an active role.
