Fraud is a common social life usurpation of crimes. With the development ofsocial life, and affected by many factors influence, deception and fraud methodsconstantly renovated. This paper involved defraud state subsidies related cases,although there are only violation of financial laws and regulations, it does not rise tothe level of a crime, although some may be suspected of fraud, but that the judiciaryhas not yet been tried, and they can not be identified crime. However, these cases havein common are the relevant units or individuals through a variety of methods ofdefrauding the state subsidy funds, resulting in the loss of state funds. Therefore, thisarticle will focus on the analysis of the conten. This Article selected fourcases,where there is a judgment of the High Court of Hong Kong. The responsibleperson has to be convicted of fraud sentencing Hong Kong Public Welfare. In contrastis the China mainland for defrauding the State subsidy funds of the case. Itsprocessing results are not the same as Hong Kong’s jurisprudence on the responsibleperson criminally investigated.This is mainly on China’s Hong Kong and the mainlandboth the legal and institutional subsidies for defrauding the State regulations vary, Atthe same time, the current in theory and practice of defrauding state subsidies for suchacts of identification is still controversial about the nature and differences. This paperfocuses on the study of properties of defrauding the state subsidy behavior, from howto improve our auditing system, establish and improve the focus of legal norms,combined criminal law and criminology theories analyzed some related to defraudstate subsidy case. For the problems that exist in real life, put forward somesuggestions for improvement, in order to better guide the future work of auditpractice.
