All kinds of data are showing that the Art market in China is reaching a fastdeveloping period. The numbers of collectors and collection groups have increasednoticeably, so have the level collector’s taste. With the steady development of theenvironment, the leasing market of the arts has a large room to grow. It helps to trainand prepare collectors, to promote artists, to encourage trading of the arts, and to makethe atmosphere of the market more vibrant. It is the inevitable outcome of the artmarket progressing.The main form of the art trading abroad is through the Bank of Art. Even thoughsuch practices have been successfully adopted in Australia and Canada, the successfulcases are still rare in China. It is still in the early stage of newborn and discovery.Though difficult, the author still believes that the art leasing market will see itsopportunities of development. However, simple copy of foreign practices may not besuitable for the domestic market. It is necessary to deeply study and establish relevantlaw and regulations of Arts Leasing first is evident and it is of great value to study suchmarket.This thesis covers the comparison of the characteristics and risk factors of artsleasing with normal goods leasing; the credit system of arts leasing with internet basede-commerce credit system; the leasing and sale of the arts as opposed to that of houseand auto leasing and sales; the comparison of art appraiser to lawyers and accountants;the responsibilities and rights of the leaser and lease. The thesis discussed thenecessity, probability and practicality of art leasing in China and ways of how toimplementation to avoid or minimize the risks. It also analyzed the art leasing marketfrom a judicial stand point, the two parties involved in art leasing; the responsibilitiesand rights of the leaser and lease; their respective risks; the compensation of artdamage, and third party goodwill possession; the reasonable use of copy rights etc.This thesis points out that the difficulties of pushing art leasing market into deeperlevels arise from the missing of art pieces registration system; the defectiveness ofauthenticity verification system and the lack of authority of art piece appraisal.Under the general guidance of China’s culture promotion policy, the author callsfor the expedited establishment of laws regarding art management and trading, and thebetter regulations and rules for the relevant government agencies to enforce such laws,solving the problems that are facing the art leasing market.
