The law of genocide is governed today by the Convention on the Prevention andPunishment of the Crime of Genocide1948. However, the aim of this dissertation isto attempt to identify customary International Law which viewed genocide as a crimeeven prior to the enactment of the1948Convention which the Armenian Genocide of1915-1922saw the Ottoman state breach. If there is enough evidence to suggest thatis the case, the author will examine the possibility for claiming compensation andrestitution for the victims and descendants of this historic tragedy, which still carries agreat deal of resonance today. All of this will be done with a backdrop of an analysison the political and historical issues, which are associated with the ArmenianGenocide and its lack of recognition by Turkey. In turn, this dissertation willhighlight the disparity between what actually is possible in terms of international lawin providing justice to those who seek it and what is realistic given the issue’s heavilypoliticised nature; an issue which continues to haunt Turkey and Armenians afterninety nine years.
