A Study On Legal Problems Of Shipment Of Nickel Ore

Compared with carrige of general goods by sea, shipment of nickel ore does have its own risks on transportation. Specifically speaking, nickel ore belongs to easily liquefied goods. And the proportion of moisture of cargo should be strictly controlled during its navigation, for high proportion would lead to liquefaction and affect the stability of vessel, bringing about extra loss of time and additional charge. Thus, there is also many disputes between shipper and carrier. Therefore, it is nessary to study on the legal problems which may arise out of the shipment of nickel ore from a legal perspective.This paper consists of four parts. The first part is about regulations about types of nickel. It compares brief contents both international and domestic, to definite the scope of nickel ore which is adjusted by legal laws and regulations. At last, it also provides some reference to improve the content management of nickel ore. The second part is about the relationship between nickel ore and dangerous goods. The chapter discusses the defintion of dangerous goods briefly, and establish connection to nickel ore based on its liquefiable characteristic. The third part is about notification obligation of shipper along the shipment of nickel ore. With overall analysis on what such particular obligation is about, this chapter also provide two condition, where shipper can reduce or even exempt the duty attributed to violation of this obligation. Similarily, the fourth part refers to transportation obligation of carrier among the shipment of nickel ore. It emphasizes on the distinguished cautions in every links of said duration, and probes into when carrier could not to perform this obligation.
