The Crime Of Child Molestation Legislation Research

Child molestation crimes not only seriously infringe upon the personal rights of children, but also severely damaged disgraceful consideration and to the harmonious order of the society. A series of relevant law and policy in our country, through legal channels to achieve the protection of children, in the aspect of criminal law, the provisions of the crime of child molestation. On October23,2013, the supreme people’s court, the supreme people’s procuratorate, ministry of public security, the ministry of justice issued "about sexual assault the opinions of the minor crime punishment according to law", to provide more detailed criminal law judicial investigators apply basis, however, the existing criminal law there are drawbacks. In this paper, the research on legislation of crime of child molestation, hope to provide reference to modify the crime of child molestation.The first part of our country criminal law crime of child molestation overview, mainly from the concept and nature of crime of child molestation, the necessity from three aspects of crime constitution and legislation to expand. Extraterritorial legislation, the second part is from the civil law countries and common law countries, Hong Kong and Taiwan and the United Nations has carried on the legislation, summary analysis was carried out on the extraterritorial legislation, at the same time from the legislation system is worthy of reference for China’s legislation of summary, provide direction for our country’s legislation. The third part is the legislative defects of the crime of child molestation, this part of the typical cases from judicial practice, legislative defects exposed the legislative defects and reasons to the crime of child molestation in three parts this paper summarizes the legislative defects, and find out the legislative shortcomings. Legislative Suggestions in the fourth part is the crime of child molestation, this part on the basis of other country legislation, combined with the reality of our country, discusses the necessity of legislation of crime of child molestation perfect, from children to define the scope and indecent assault of legislation, independent and statutory punishment of the crime legislation setting four aspects to perfect legislation.
