The Jurisdiction Of Network Infringement Cases

With the development of modern society and the improvement of network technology, the network has penetrated into the human life. Also, the wide application of the network not only changes the people’s lifestyle and life quality, but also provides humans with new communication methods. However, a new type of infringement behavior comes out along with it, which is the network infringement behavior. As there are some special characteristics of the network, it is extremely complex to identify network violations and give an appropriate legal liability. New problems during the processes of dealing with network infringement cases keep bothering the academic and practical departments in different countries。 So the traditional legal system has been challenged unprecedentedly. And the premise of how to handle these legal issues is the jurisdiction of these cases Therefore, enacting and improving the legal system of network jurisdiction must be given priority attention in order to deal with network infringement cases in a better way. This paper puts forward a legislative conception for the improvement of our network infringement jurisdiction through the analysis of the conflicts and challenges between network infringement cases and traditional jurisdiction rules, the comparative study on extraterritorial jurisdiction for network infringement cases and the research on current situation of network infringement cases jurisdiction.
