Analysis Of The Application Of The Minor Social Investigation Report In Detection Phase

Minor social investigation regime is a new regime in the newly-amended Criminal Procedure Law, the Article268of which for the first time established the Regime from the legislation perspective. In the past decade, local criminal judicial departments have been proactively launching the pilot program of and exploring the Regime. However, many issues involved in the Regime are left confusing and unsettled both in theory and in practice due to the fact that such Regime is still at the exploratory stage and that current legal system has not yet forming the unified model to deal with issues involved in the Regime. This essay, based on the theoretical ground of minor social investigation report, through the deep exploration of the subject, content and procedure of the minor social investigation report, utilizing the relevant theoretical research and working experiences of myself, re-reviews the operation of the minor social investigation report in the detection phase to locate and analyze any potential problems and to further make suggestions to improve the minor social investigation report in the detection phase.
