The Theory And Practice Of The Adoptive Relationship In China

The adoption system as an ancient social system is a significant part of family system which is one of the superstructures of the society. The Adoption in law is a kind of civil legal behavior that require someone to adopt the children from other family to become his or her own children. The behavior makes the legal relationship between the adopters and children and the children will terminate their relationship on their previous family. Adoption law in China was promulgated in December1991which is22years ago. As the development of economic and society, the adoption law can not meet the requirement of the practical society life. Therefore, the community from the different sections appeals to modify the adoption law.This essay will systematically elaborate the theory and practice of the adoptive relationship in China using the method of the theoretical analysis and the empirical analysis. In addition, this essay will reveal the related regulations of the adoption law and systematically analyze the practical problem from the different wide point of view and wide field. A complete adoption system is proposed solve legislative and judicial defects of the adoption law.
