In today’s globalized economy, it seems that everybody is provider, and provider is ineverywhere which showing a scene of prosperity in commercial areas. In addition, thefield of law on various research areas of modern commercial activity in the breadth anddepth of the march has no exception. The field of law as well as commercial law todiscuss various issues providers can not always be out of the cycle of large civil law, andeven basic questions such as independence, must be confined to discussions ofcommercial law in the range of civil and commercial relations. In fact, commercial law inthe dimension of history has never stopped the pace of evolution, because the spirit alwaysguides the innovation of commercial law. At the same time, commercial with innovativethinking virtually keeps pace with the commercial system. Therefore, to grasp thecommercial thinking, has become an important way to feel the pulse of the atmosphere’spresence in the legal field.The commercial thinking, of course, is in the presence of field activities andcommercial exchanges between commercial trial practice. And commercial thinking isthroughout the various specific commercial legal system. Therefore still in the initialstages, we explore independence of Commercial Law. But this independence is not a formof independence simple sense of the Commercial Law, but the essence of independence ofthe Commercial Law, which provides a summary of the basic platform for the tangiblecommercial thinking. Of course, theoretical work on the intangible commercial thinkingcoming into grasping tangibly is not only the result of the development of the theory ofcivil as well as commercial matters, but also an inevitable requirement of commercialpractice in the development process.The commercial thinking of tangible inductive conclusion should be a rule thatpeople perceived to be visible and easy to grasp. In addition such rules can be oneunbundled. This decomposition process shows actually thinking and practice keeping intopace. The elements of the internal logic of commercial thinking rule are three points, it canbe also said that commercial thinking process is divided into three steps. First step is torecognize the special nature of commercial relations, which is for the fact that current people’s awareness of the commercial relationship is low. It is not proper commercialthinking step, which is forced to move; second step lies in the concept of strict compliancewith commercial, where the concept is a commercial structure with a pyramid-stylehierarchy, and is a multidimensional system including the Commercial Law value, theCommercial Law principles and the specific terms of the composition of commercialsystems; final step, the form of commercial thinking returns back to a non-commercialeffects regression. But we emphasize that this mode of thinking is only a given mode ofthinking, its essential purpose is not to give specific rules of adjudication of a particularcase, rather to establish and develop a commercial audience thinking.Though the purpose of this article is that the culture audience commercial thinking,the result of thinking culture still ultimately implement the commercial judicial practice.So this is still trying to give the referee and interpretation under commercial thinkingguidance. Commercial thinking expansion method in specific cases can be find fromminor premise analysis of the facts of the case in various Commercial Law summarizesthe provisions of the system and finding the specific legal basis for the premise tocommercial trial set forth in the applicable law and technology. But this interpretation ofthe law referee and explore technology staying in the paper, this paper further distinguishcommercial trial practice in civil and commercial cases, the origin of commercial law andcommercial value of options and recheck goals made specific and detailed discussed, inorder to develop commercial thinking to make specific nature and rich paradigmguidelines.
