With the development of the technology and information, the personal information is becoming more and more important as a kind of necessary society resources in the modern society. Due to property character of the personal information, cases that by collecting and selling other person’s information to make a great profit are no more uncommon. These behaviors not only can damage the rights of information subject, but also have threat to the social order and public interests. In the field of personal information protection, many countries and regions have already published some relative law. Typically, the Distribute legislation mode in United States and the privacy rights is its center part. Another one is the centralized legislation mode in German with the core part of self-determination rights.Nowadays, despite several relatively legal terms dispersed in some legislation, our country hasn’t possessed a perfect and special law to protect the personal information. Therefore, from the perspective of civil law, in the first chapter of the thesis, the author focused on defining of the personal information’s concept and characters, distinguished it from the privacy rights, and demonstrated finance and personality property of the personal information. In the second chapter, referenced and compared to the personal information legislation of the other countries and regions, and according to china’s actual conditions, the author proposed issues in the aspect of personal information protection that need to be paid attention to. In the third chapter, the author discussed and analyzed the present situation, then pointed out existing problem of china’s personal information protection.
