Study On The Copyright Collective Management System Of Audiovisual Works Under Tri-Network Convergence

With the "tri-network convergence" time coming, the works spread more conveniently and rapidly. Massive new types of audiovisual works appear, while content of the copyrights is expanding and more and more subjects need to be authorized,which causes that licensing costs will be greatly enhanced.Among these problems, how to obtain a license is the most fundamental issue. Copyright collective management organization could offer licensing for users, to solve the dissemination and use problems of mass works in the network. However, the copyright collective management organizations face the old and new problems under tri-network convergence and there are some difficulties for works licensing and tracking.In China,the only collective management organization for audiovisual works—China Film Copyright Association, founded in2010, and its development in itself is not perfect. Faced with the arrival of tri-network convergence, the model of existence and internal management system have many problems, so it is difficult to effectively play its performance. On legislation, the collective management of audiovisual works is still lagging behind.which still needs to improve. Over the third revision of the copyright law, whether to introduce the system of copyright extension management causes considerable controversy. How to improve our system of collective management of copyright legislation is particularly important.Throughout the research situation, study on the licensing model of audiovisual works under tri-network convergence is still at an early stage.Therefore.this article will focus on the new features of audiovisual works under tri-network convergence technology and the present situation of copyright collective management system so as to put forward to rebuilding and suggestions for improvement about copyright collective management of audiovisual works.This article is divided into four chapters:the first chapter introduces the basic concepts of audiovisual work and copyright collective management system,including audiovisual works concepts and the concept definition and the copyright origin,nature and modes of collective management system;The second chapter introduces the new problems of audiovisual copyright collective management system under tri-network convergence technology background, including an overview of tri-network convergence, the copyright collective management problems for audiovisual works under tri-network convergence as well as the significance analysis for collective management; the third chapter is about the foreign copyright collective management experience as well as the introduction of reference, including Germany, the United States, Norway, Russia and France; the fourth chapter of the article is the most important part, which focuses on the Chinese copyright collective management system improvement under tri-network convergence for audiovisual works,including two aspects:the mode selection and legislative rebuilding.
