The Research Of Optimization Of Cases Quality Evaluation System In People’s Court

With the construction of legal society, People’s counts always play an important role, In recent years, a large population are much concerned about the adjudgements of most of the hard cases, such as Peng Yu case, misjudged case of rape by the uncle and nephew happened in Zhejiang and so on. However, there are some flaws revealed in the adjudgements of these cases indeed, some of which are even cases of wrongly. Therefore, the chief problem that the course of justice faces is how to improve the quality of cases in People’s counts.In the Third Plenary Session of the18th CPC Central Committee, judicial openness of People’s counts becomes the public focus. The openness, an external driving force, aims to push the course of justice. Yet, scientific management of adjudging deserves the same attention as judicial openness, which is the inner driving force. Case Quality Evaluation Work is the significant means of adjudging management, the concept of which in future shall be based on evaluation work, with all sorts of supporting policies. Thus, whether the development of evaluation work is reasonable or not will deeply affect the effect of management, thereby affecting the quality of adjudgment.The study of performance evaluation of adjudging management began late in our country. Case Quality Evaluation Work, whose relevant theory study can’t solve the problems appear in practice effectively, was actually established in2008. This paper focuses on Case Quality Evaluation Work and compares with the development of evaluation in foreign countries. It absorbs advanced experiments of foreign countries to analysis the advantages and disadvantages of evaluation work today. And then by checking the experimental data with statistical analysis tool, the paper evaluates the reliability and validity of evaluation work and presents the suggestions of policies.
