The issue of age discrimination in employment in China is becomeing more and more serious today,and it attracted people’s attention gradually.In today’s increasingly severe employment situation and increasingly competitive employment situation, more and more people suffer problems of age discrimination.Age discrimination has become one of the most influential and most widely spread discrimination.It is different from the probability of the existence of other forms of discrimination like gender, disease, education, etc. appear, everyone will experience it, because time is irreversible and can not escape.Age discrimination in employment not only undermine social order, but also greatly changed the Chinese people morals and values.But our country’s current legal system and relief programs can not protect the groupe by age discrimination effectively, resulting a series of negative effects.in order to solve the existing problem of age discrimination and propose measures on institutional theory and practice, this paper try to analyze the status quo of China’s current age discrimination and age discrimination connotation, characteristics, learn from overseas anti-age discrimination in employment law system, especially the relief program, the burden of proof and that standard allocation.
