Ownership of buildings including rights of distinguish all members, exclusiverights and ownership rights. The differentiation ownership of ownership of buildings(or distinction between ownership) has always been the difficulty in the theory, theresulting controversy is complicated in reality. This article mainly discusses thedistinguish of the case study of ownership, and Suggestions were put forward.In this paper, we selected four cases of differentiation ownership of ownership ofbuildings.each of the controversial focus of four cases, summarized respectivelyabout residential area green space and underground parking spaces, the roof platform,window area of club ownership problem. This article mainly apply the case analysis,comparative analysis method and inductive reasoning method, analyzes the reality ofthe right of common, finally come to the conclusion and puts forward relevantSuggestions and improvement methods.Combining with the right of common case analysis, the following conclusion: theresidential district underground parking space should be particular case is particularanalysis, the author thinks that residential area underground parking spaces shouldbelong to the area of developer. For flat roof of the ownership, the author thinks thatshould be the common parts of the building, the developers can’t with specificexclusive right of the owner agreed. About the green of the window, the authorcombined with the property law of green space and the nature of the rights, the authoranalyzes the "green space within the building zone","green land proprietary rightsagreement" and the "individuals". Finally is the cognizance of the village clubownership and perfect, the author first carried out on the residential clubhouse andexpounds the types of community club, and then through the understanding of"property law" relevant provision, case and combining the principle of four clubbelonging to the village and ownership were identified, finally put forward for village club ownership of perfect.
