Research On The Hainan Low-Altitude Airspace Management System Of Legal

With the rapid development of our national economy and the deepening reform of low-altitude airspace, the aviation sector in China is facing the unprecedented opportunity. Civil aviation transportation is growing at an average speed of10%per year, general aviation demand grows with each passing day, the demand for the spatial resource is also growing, The Party Central Committee, the State Council, the Central Military Commission attach great importance to the development of the aviation industry and do a good job in ATC work. In the joint efforts of both sides of the army, China’s airspace reform is advancing steadily, airspace resources are maked full and effective use gradually. The State Council of the Central Military Commission jointly issued "on deepening reform of China’s low-altitude airspace management advice"(referred to as "opinions")in October,2010. It decided to make necessary reform of low-altitude airspace management in china, developed and utilized low-altitude airspace resources fully, and promoted general aviation, aviation manufacturing industry and the development of comprehensive transportation system. As a pilot area, in Hainan the legislation and system construction of the development and utilization in the low-altitude airspace is not perfect, with the aid of low-altitude airspace management system reform of this opportunity, it is necessary to make full use of low-altitude airspace, and improve the legal system for the low-altitude airspace. The article embarks from the reality and theory in combination with the practical situation of Hainan area, it analyzes the reform of China’s low-altitude airspace, according to the characteristics of the Hainan Special Economic Zone of the geography and economy, it draws lessons from the beneficial experience to provide feasibility thought for Hainan low-altitude airspace reform, it provides legal system guarantee to promote the reform of low-altitude airspace of Hainan even the whole country. There are four sections in this paper, the first part is a comprehensive overview of the general legal system for altitude airspace. Focusing on the connotation of low-altitude airspace is to introduce the legal attribute of low-altitude airspace and the classification of low-altitude airspace system. The second part mainly introduces content of the legal system of China’s low altitude airspace, analyses the main problems existing in China’s low-altitude airspace law system and its reform direction. The third part is the present situation of the reform of low-altitude airspace international tourism in Hainan Island. The first is to introduce the importance of low-altitude airspace reform for Hainan development, the second is to introduce the advantages of Hainan low-altitude airspace reform. Finally it is pointed out the legal problems existing in the reform of low-altitude airspace. The last part starts from the characteristics of the legislation of Hainan Special Economic Zone, combined with practical problems faced by Hainan current reform of low-altitude airspace, it puts forward constructive suggestions, and provides theoretical basis for speeding up the reform of low-altitude airspace system in Hainan special legislation.
