The economic compensation in non-competition agreement refers to the compensation that employers pay to the employers who know the employers’ business secrets. Due to inequality between the employers and the employee, it have to protect employees to ensure substantive justice of non-competition agreement by law.Although the Labor Contract Law in article23,24and Judicial Interpretation (Ⅳ) have made legal provisions to The economic compensation in non-competition agreement, these articles are still imperfect. There are many questions need to be researched,such as how to define the employee subject of non-competition agreement, how to ascertain economic compensation standard and pattern, and how to confirm the order of economic compensation and the employees’ non-competition obligation.Depend on the analysis of the problems which economic compensation in non-competition agreement has, the author will put forward the proposal to these problems:to define the subject of the economic compensation, to determine a variety of compensation ways, to establish mandatory economic compensation standards and to create scientific order between economic compensation and non-competition obligation. I wish it will Improve the non-competition provisions of economic compensation to protect the employees’right by my suggestion on economic compensation in non-competition agreement.
