Collective Research Of Music Copyright Management System

Due to the limitation of the traditional concept, free use of music works has a strong impact on current development of the music industry to our country. Its fundamental reason is the change from planned economy to market economy on the economic system of our country, people paid more and more attention to their own right, and for the pursuit of commercial interests, there are the subject of urgent research how to protect the interests of the obligee, establish a good marketing economy operation, and promote the development of long stability of the music industry, music copyright collective management has become the focus of people’s attention. Music copyright collective management of our nation has been running more than twenty years, but due to legal system fall behind serious, many problems can’t solve on time, lead to reduce obligee’s enthusiasm.This paper mainly apply some methods include literature analysis, normative analysis, comparative analysis and so on, trying to resolve on administration of music collective management organization is too strong, charge standard and allocation method is not reasonable, and whether the extension of copyright collective management system is applied in our nation or not. Finally, learn from Hong Kong and Taiwan area, as well as the experience of the developed countries of the music copyright collective management,come up with the measures to strengthen the legal regulation,namely during amend the Copyright Law, to make sure the question form the copyright collective management pattern, the legal relationship, charge standards and distribution, extension of copyright collective management system and improve Regulations on Collective Administration of Copyright at the same time, to ensure the orderly development of China’s music works copyright collective management.
