Research On The Property Act Regime

In china, the history of Property Act Theory research is not long. The views of Property Act Theory in China mostly from the views of Property Act Theory in German、Japan and Taiwan. There are so many controversies about Property Act Theory in China civil law area. Some professors approve Property Act Theory, but many professors are opposed to this theory and think the theory doesn’t suit to China society.China Property Law enacted in2008doesn’t adopt Property Act Theory. Under the guiding role of legislation, more and more academics hold anti views about Property Act Theory and misunderstand this theory useless.This article attempts to reformulate Property Act Theory, clarify misperceptions of Property Act Theory. The main content is divided into there sections:The first chapter attempts to formulate the concept of Property Act, define Property Act as "Property Act has a purpose of direct change property, with property intention and delivery form or registration form". The second chapter attempts to introduce content of Property Act Theory. Property Act Theory includes independence principle of Property Act and abstractness principle of Property Act. The last chapter discourses the relationship between Property Act and Acquisition in Good Faith, think two theories are Complementary.
